Resumen

The Directive 2016/800 promotes the rights of the child, taking into account the Guidelines of the Council of Europe on child-friendly justice. Its purpose is to establish procedural safeguards to ensure that children, meaning persons under the age of 18, who are suspects or accused persons in criminal proceedings, are able to understand and follow those proceedings and to exercise their right to a fair trial, and to prevent children from re-offending and foster their social integration. In this regard, this Directive establishes common minimum rules on the protection of procedural rights of children who are suspects or accused persons and aims to strengthen the trust of Member States in each other's criminal justice systems and thus to improve mutual recognition of decisions. Likewise, the publication of the Directive 2016/800 represents an important step in the construction of a Common European framework of crime youth.
