Resumo
The Spanish Civil Code provides that collation generally refers to forced heirs. The scant dicta concerning collation evidence almost unanimously that the provision of collation does not apply to widowers and widows. Thus, it is considered that they do not have to collate nor can take advantage of others’ collation. The purpose of this article is to examine the grounds for denying this possibility as well as reflect on the favourable reasoning for it
