The modification of the Law 8/2021 of June 2, reforms civil and procedural legislation to support people with disabilities in the exercise of their legal capacity, does not resolve the existing contradiction in cases with an international element. That is, there are disparate solutions in Spanish legislation between the criteria for determining the law applicable to the capacity to act and the rules for determining the law applicable to protection measures for the incapable. The new regulation maintains this contradiction in cases of private international law in which an incapacitated person intervenes, but it refers to disabled people. This issue may be of key importance in practice to resolve the legal bicephaly resulting from the CC conflict rules, contained in art. 9.1 and 9.6 II respectively.
