La violencia filio-parental en relación con el derecho de corrección del menor infractor

Abstract

Child-to-parent violence is a problem that affects many families in our country and even taking into account that there is a very high black figure, the data that is handled reveals that fathers and mothers are reluctant to denounce their children. and daughters. The explanation for this behavior in minors is multifactorial and one of the most relevant factors is the education that is currently provided to them. In this work, it will be investigated if the right of correction in the Civil Code is in force, what problems there were on the part of the jurisprudence on the limit of this right and physical and/or mental violence. In addition, the current criteria of the Supreme Court in relation to habitual intrafamily abuse is studied. A series of real cases of child-to-parent violence will be provided, to end with some conclusions and proposals.
