Abstract
There has been a lively debate amongst Roman law scholars regarding the juridical origin of the position of praefectus urbi, given the panoply of admin¬istrative and jurisdictional powers attributed to it, the latter extending to both criminal and civil cases. This was the result of the historical evolution of the political organization of the Roman state, over time. Hence the need to refer to the related sources to clarify the relationship between these pow¬ers, and the fundamental principles on which political power was based in each phase of the evolution of the republic until the Roman empire
