Abstract

This thesis deals with one of the most heinous forms of crime in this day and age as it entails one of the most serious attacks on human dignity, the crime of trafficking in human beings. This study is based on a broad and multidisciplinary approach in order to avoid a simplistic and biased conception of a complex criminal phenomenon. To do this, the investigation begins with a criminological approach to the felenoy that provides valid and effective information about the crime, victims, traffickers, their forms of action and prevention. Once analysis was concluded, international and community regulations were consulted so as to conceptualize human trafficking, the aim to determine the regulation of the felony in our Legal System, as well as the treatment which it has received in the legislation of our neighboring countries, the latter, as a source of inspiration through the knowledge of other legal realities to then carry out the systematic analysis of the autonomous type of article 177 bis of the Penal Code, introduced in the criminal legal system by Organic Law 5/2010 , in order to determine whether the action of the Spanish legislator has complied with the international commitments acquired, by means of a critical stance to contribute to the improvement in the typification of this criminal figure. The text study concludes with a victim-centric approach allows to place the victim at the center of political-criminal decisions regardless of their position in the criminal process to, at the same time, guarantee respect for the informative principles of criminal law, fundamentally the principle of minimum intervention
