Zusammenfassung
This paper studies the compatibility between the awarding of costs for bad faith on the part of the defendant in the extraprocedural satisfaction regulated in article 22.2 of the Civil Procedure Act and the principle of effectiveness of European consumer law. To this end, an analysis will be made of the jurisprudential interpretations given by the Spanish Judges and Courts on the award of costs in the case of extraprocedural satisfaction in order to project them in the light of the principle of effectiveness and conforming interpretation.
