Abstract

Mutual recognition has gained renewed prominence after the communitisation of the field of Civil Judicial Cooperation, as it constitutes the axis or vector that allows the construction of the new global public policy on the administration of justice projected by the Commission. Without prejudice to the differences and similarities that can be seen between this notion and the one used for the liberalization of the internal market, the full legal recognition of the personal and family circumstances of citizens constitutes an objective of the EU, especially after the adoption of the Stockholm Program in order to achieve the Space of Freedom, Security and Justice. This recognition guarantees the free movement of people, by providing stability to civil status and preserving personal identity. Although there is no political support to achieve this result through legislative interventions, such recognition is currently taking place within the European space.
