Zusammenfassung
This paper is a comparative study between criminal-legal guarantees system of Former Regime and how the ground-breaking legislation by the Cortes of Cádiz allowed a modern system of guarantees, in particular the abolition of torture as a valid mean of taking evidence. Thus, it will be take in consideration the status of the matter today, and the different pathologies that still remaining.
