Abstract
It is being more difficult nowadays to purchase real estate. Furthermore, if it became the permanent and loving family home, abandonment, deprivation or division of the marital residence could be the focus of a battle for possession in the couple when they decide to end their relationship. This research paper hereon would through light on what recent case-law establishes regarding division of the real estate in the marriage or de facto couple, as well as on the use of community property as a legal resource in sharing the property in de facto couple cases.
