Abstract

On the basis of the post-classical reforms in terms of successio ab intestato, different hereditary appeals are suggested in favor of the filii in relation to the bona of the deceased; culminating this process with the reform carried out by the Emperor Justinian in the Novella 118 with the objective of harmonizing the system in the event of the existing legislative proliferation. That is why these reforms set the elements of historical continuity in the legal tradition and in the Codification.
