Justicia constitucional transicional y jurisdicción constitucional en la constitución tunecina de 2014

Résumé

Following the adoption of the Constitution of 2014 in Tunisia a transitional body has replaced the previous Constitutional court until the final implementation of the Constitutional Court, so this article will address issues such as the different nature of the constitutionality control of laws adopted by the transitional legislature in the absence of a constitutional jurisdiction and the issue of the exercise of that jurisdiction by a transitional body that has played therefore a transitional constitutional justice. Finally, in line with what happened in Morocco, Tunisian constitution makers have also attempted to present the transformation of the Conseil constitutionnel into a Constitutional Court as a qualitative change that would involve the creation of a genuine constitutional jurisdiction, organ whose composition and tasks are examined.
