Resumen

The main question is not whether or not this right exists within the current Spanish Constitution or whether the refusal of a consultation - in order to know the opinion of the people on the separation of the Spain - contradicts or not the clause of the Democratic State expressly contained in Art. 1.1 of the Spanish Constitution, but rather whether this right presupposes a denial of the constitutional State. The proposed demonstration also raises the question the establishment of a democratic decision-making process so that an autonomous Community can become independent of Spain. It�s easy to understand that even if a constitutional reform is necessary in such a case, it isn�t the exercise of the right to decide but the exercise of a sovereign power which would then imply a redefinition of the Ownership of sovereignty which, in fact, no longer belonged to an indivisible subject.
