Résumé
This paper tries to explain the concept and the evolution of the principle of proportionality. It is a German doctrinal and jurisprudential construction which was born focused on the scope of criminal law –requiring the adequacy of the punishment to what is strictly necessary–, but which quickly spread to other areas of law, especially to constitutional justice, in which, however, its use has raised a number of objections.
