Zusammenfassung
We analyze the application of the accusatory principle by the Constitutional Court in the sentence 155/2009, of 25th June, and its consequences. We also analyze the article 6.3 a) of the European Convention on Human Rights regarding to the defendant's right to be informed of the accusation held against him. Finally, we compare the interpretation that as much the Constitutional Court as to the European Court of Human Rights have carried out about this principle.
