Abstract

State of Transparency is the gradual global establishment of the concept of transparency and the right of access, anchored constitutionally as fundamental, established in the three branches of the Spanish democratic state as a result of the Great Recession of 2008 and through Law 19/2013, of December 9 of Transparency, Access to Information and Good Government, which is analyzed legally. Thus, it is exposed how is the extended legislative structure of transparency which raises and suggests the constitutional recognition of this as an emerging fundamental right and not the constitutionally recognized right the origin from which the structure of that right unfolds. To this end, a comparative law study, a bibliographic review and a classification of background and doctrinal positions are carried out together with a set of current practical elements with the aim of offering a general overview of the current state of transparency, proposals for improvement and reflections of implementation
