Abstract

In this investigative paper, we examine the knowledge we have on unilateral masculine violence, especially psychological violence, against the female counterpart. In relation to the mental injuries mentioned in article 153.1 CP, the knowledge derived from the field of psychology and the field of psychiatry, the disappearance of article 153 CP should be sustained due to the fact that the conducts that the male makes relating to mental aggressions do not have scientific precedence that justify their criminal penalty. Thus, article 153.1 CP punishes them as conducted mental injuries, when in reality they are not. Only the habitual violence with purpose of dominating, subjugating, and even doing away with the victim could cause damage, not only mental but also physical. This justifies the criminal penalty present in the criminal framework of injuries.
