La protección jurídica de las personas con discapacidad a la luz de la Convención de Naciones Unidas de los Derechos de las Personas con Discapacidad

Abstract

The Convention changed the regulatory medical criteria for no social discrimination criteria. Therefore we must maintain a broad and flexible concept of disability, including many of the social situations or at risk of exclusion. The Convention starts from the idea that disability resides in society, not in people, who can acquire the capacity to be equal to their fellow citizens by adapting their skills to the necessary support. This has not happened overnight. This is the main objective of this thesis, that is, reflecting that evolution has occurred over the years in our systemand asking about steps and changes that the Spanish legal system needs to adapt itself at the mentioned Convention.
