Resumo

This study takes as its premise that the Administration of Justice requires modernization and that one of its main group of actors, the judges, must act in accordance with a model of decision-making quality. Focusing on Spain and constitutional democracies, the analysis works towards the goal of maximizing the right to effective judicial protection under Article 24 of the Spanish Constitution. The paths followed towards such empowerment are included in extensive international and European Union standards (Spain is an EU member State), as well as in various plans, strategic programs, guides and reports. With regard to the scope of judicial action, we note how acceptable quality levels will only be achieved when there is accommodation to current law and when its content is fair.
