Résumé

The international labour process is a judicial process in those cases in which exists an international labour litigation. This PhD thesis explains the international judicial competence in social order, that is, in which cases the Spanish social jurisdiction is competent for isolating, knowing and solving an international labour litigation. Moreover, the dissertation deals with the legal assumptions that must be validly established so that our judicial organs may solve the issue. Likewise is analyzed when the foreign law must solve the litigation, and specially the evidence of contents and validity of foreign labour law as previous requisite for judicial application. Finally, the last section of the dissertation is devoted to the examination of the recognition and execution of foreign labour sentences that expect to be recognized and executed in our country as a manifestation of effective guardianship right at transnational scale.
